Workers’ Compensation Made Simple

By: Fry | Goehring

If you suffer an injury at work and it is deemed you can receive compensation, you may be entitled to workers’ compensation. Upon receipt of worker’s compensation, you will receive medical benefits, rehabilitation support, and supplementary income. The purpose of worker’s compensation is to help the injured party in their return to work. If a work-related injury results in the death of an employee, any dependents may be eligible to claim benefits.

Workers’ Compensation

You should report an accident right away to your immediate supervisor or a person in a position of authority within the company if your supervisor is not available. The time frame for reporting an injury is a month – although you may be able to claim after that time it is not recommended as you may not qualify to receive benefits.

Claims are filed by completing form WC-14 with the State Board of Workers’ Compensation. You must also send a copy of this form to your employer and their workers’ compensation insurance company. Employees who miss more than 7 days of work because of injury are eligible to receive two-thirds of their weekly wage. The maximum you can receive is currently set at $575 per week. In some cases, injured employees will continue to receive benefits for up to 400 weeks.

Issues with Workers’ Compensation

If you encounter issues such as an employer refusing to provide workers’ compensation, there is help available to you. It is illegal for your employer to delay or deny workers’ compensation if you are entitled to the benefit. The State Board of Workers’ Compensation Enforcement Division will carry out an investigation which may result in your employer being fined for failing to provide worker’s compensation.

If the issue you are facing is being denied workers’ compensation due to problems with reporting your injuries or the claim itself, there are other options that will enable you to pursue a resolution. You can consult with a worker’s compensation lawyer who understands the steps you must take to support your claim.
